Guidelines and Agreements

As a web hosting provider, we have a responsibility to protect each of our clients in order to provide the best services available. The following policies and guidelines are designed to insure these services. We reserve the right to update our policies and will make them available at vrbwebs.com/terms.htm

Content:

All services offered at vrbwebs.com may be used only for lawful purposes. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited This Agreement shall be governed in all respects by the laws of the State of Texas in the United States of America. This includes, but is not limited to: copyrighted material, material we judge to be threatening, obscene, demeaning to others, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold us harmless from any claims resulting from the use of the service which damages the subscriber or any other party.

Note: Pornography and sex-related merchandising are prohibited on our server(s). This includes sites that may infer sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the internet. Links to such materials are also prohibited.

In addition any site selling or promoting Bulk email services is not allowed and any violation of this policy shall be deemed as reason to deactivate the offending account without refund:

Examples of non-acceptable content or links:

Pirated software
Adult-Oriented Sites
Advertising for any Adult-Content Services
Sites that distribute "Spyware" Software
Hackers programs or archives
Warez Sites
Irc Bots
Mp3 if being illegally distributed

Vrbwebs.com will be the sole arbiter as to what constitutes a violation of this provision.

CGI Scripts:

Each account comes with its own cgi-bin. You are free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that affects or interferes with normal server operation without prior warning.

Chat Rooms:

We do not allow clients to install their own chat rooms.

Background Running Programs:

Background daemons in general are prohibited, we will consider requests on a one on one basis. If allowed, extra charges will be assessed based on resources on system maintenance needed.

IRC:

We do not allow IRC or IRC bots to be operated on our server(s).

Commercial Advertising - Email:

Our server(s) may not be the source, intermediary, or destination address involved in the transmission of spam, flames, or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. Advertising sites on other servers which in turn contain links to a domain on our servers is prohibited. We consider spam any mass unsolicited message in the mediums of Newsgroups and Email. If you are found to have spammed, then we will immediately, without warning, disable your domain. In addition, we may impose a $100 penalty for each spam policy violation. We reserve the right to refuse or cancel service to known spammers. Lastly, we reserve the right to determine what violates this policy.

As such, any violation will result in immediate deactivation of services without refund.

Server Abuse:

Any attempts to undermine or cause harm to a server is strictly prohibited. Such attempts will result in immediate deactivation and/or removal of the offending account without refund.

Indemnification:

Customer agrees that it shall defend, indemnify, save and hold vrbwebs.com harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against vrbwebs.com, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless vrbwebs.com against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with vrbwebs.com server(s); (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party and (3) copyright infringement.

Refund Policy

Policies apply to VR Barnett Web Services, vrbwebs.com, finalwebs.com, atexasdomain.com

Web Hosting: Hosting is sold on a month-to-month term and we do not offer refunds for consumed services. Hosting accounts that are cancelled in the middle of a billing cycle, must be submitted in writing to VR Barnett Web Services, PO Box 73, Turney, MO 64493. Refunds will be calculated by pro-rating any paid in advance and unused services.

MP-1 Marketing Ads: Refunds are not permitted on MP-1 Marketing Ads.

MP-2 and MP-3 Marketing Ads: If our marketing efforts do not result in a Google Page Rank of 2 or more within 60 days, VR Barnett Web Services/Finalwebs.com will refund the setup fee associated with the plan that you purchased. VR Barnett Web Services will inspect the web page(s) in question using using the Google Tool Bar to validate the current page rank before issuing any refunds.

Domain Registration: Refunds are not permitted for domain registrations.

No Warranty

WE, OUR EMPLOYEES AND OUR SUPPLIERS PROVIDE OUR WEB SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. WE, OUR EMPLOYEES AND OUR SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. This Agreement shall be governed by the laws of the State of Texas in the United States of America.

( Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you if you reside in a state other than Texas. This warranty gives you specific legal rights and you may also have other legal rights that vary from state to state.)

Refusal of Service:

We reserve the right to refuse or cancel service at our sole discretion.

Disclaimer:

vrbwebs.com will not be responsible for any damages your business may suffer. vrbwebs.com makes no warranties of any kind, expressed or implied for services we provide. vrbwebs.com disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, and any and all service interruptions caused by vrbwebs.com and its affiliates and/or employees. Although vrbwebs.com makes every effort to ensure continuous, uninterrupted and secure access on our servers, we do not guarantee continuous, uninterrupted or secure access to our services, since operation of the Site may be interfered with by a number of factors that are outside of our control.

INTERACTION WITH VR Barnett WEB Services.

Any threat, vulgar language or harassment directed at any VR Barnett Web Services Hosting staff member through phone or email may result in immediate termination of an account. Any violation of this policy by any employee, contractor or third party programmer of VR Barnett Web Services Hosting should be reported immediately.

If any terms or conditions are failed to be followed it may result in account deactivation without refund.

vrbwebs.com reserves the right to change or update policies without notice and will make said changes available online.

Anyone who believes that there has been violation of this agreement by any user of vrbwebs.com or any domain hosted by vrbwebs.com, may direct the information to our Abuse Department by sending email to abuse@vrbwebs.com or by calling 817.795.2873
